On 12th April 2021, we reported on the finding that LED lighting fixtures and lamps are often mis-identified and subsequently not reported correctly in Austria, where such products fall under the collection and treatment category of gas discharge lamps. Such incomplete reporting, if not rectified, can lead to administrative penalty proceedings.
This report has led to numerous enquiries from our customers, as we also reported that in Germany, for example, LEDs fall under the category of "Lamps, except gas discharge lamps" in lighting systems with illuminants, which can be replaced without effort by laypersons.
We would like to take the different handling of WEEE as in this Germany-Austria example as an opportunity to remind you that the WEEE Directive is handled differently in all EU member states. Each EU country has its own national transposition. In Germany this is the Electrical and Electronic Equipment Act (ElektroG), in Austria the Waste Electrical Equipment Ordinance (EAG-VO).
Associated with this is the fact that electrical equipment must be registered and subsequently managed separately in each EU member state. A WEEE registration in Germany is therefore not equivalent to an EU-wide registration and therefore only applies to Germany.
The Battery Act and the Packaging Act also have their respective national equivalents in the EU member states. When packaged electrical appliances containing batteries are sold in several or even all EU member states, the registration and administrative complexity is multiplied. Even beyond the borders of the EU, third countries have created their own regulations for appliances, batteries and packaging.
