Trading platform calls for REACh declaration: trade-e-bility offers solutions

In order to validate the REACh declaration, trade-e-bility will assist you with the document analysis. The declaration must be absolutely correct without fail, otherwise conventional penalties or claims for damages may be filed by customers and the goods cannot be sold as planned.

The IT law firm IT-Recht-Kanzlei reported on 24 August 2020 that the Amazon platform currently demands statements referred to as “REACh conformity declarations” from a large number of sellers.

The declaration must be absolutely correct without fail, otherwise conventional penalties or claims for damages may be filed by customers and the goods cannot be sold as planned. According to the REACh Regulation, manufacturers or importers of “products” are considered to be so-called “downstream users”. According to Art. 33 of the REACh Regulation, the central obligation of downstream users is to provide information to purchasers and consumers as to whether a product they place on the market contains a so-called “substance of high concern” in a concentration of more than 0.1 mass per cent. Only if such a declaration is issued will Amazon approve resale via its platform.
