New registration obligation for packaging in Spain

The Spanish packaging law obliges producers to register their packaging. Distributors from abroad must also register through an authorised representative if they sell packaged products in Spain.

The EU Product Safety Regulation is coming

As this new legislation is an EU regulation, it no longer needs to be transposed into national law; it therefore applies directly and without a transposition period.

The new EU Product Safety Regulation is coming. It will replace the old General Product Safety Directive 2001/95/EC. The latest proposal version has been available since 30 June 2022. A fact sheet in this regard is already available in German. The EU Commission expects this to enhance the level of protection for consumers, e.g., for new technical products, online purchases and through more effective product recalls.

For businesses, legal certainty is to be improved in particular through clearer regulations. Whether the new regulation can deliver on these promises is unclear. In the latest issue of the Zeitschrift für Product Compliance (ZfPC), for example, two articles criticised the implementation of these goals. Especially the new regulations on cyber security of products and the extended information obligations in case of accidents with products still seem to reflect considerable weaknesses. Affected economic actors such as manufacturers, importers and fulfilment service providers should follow further developments as they unfold.
