Product safety: Rules for products not subject to CE marking will be tightened

Plans are under way for this year to tighten the rules for products that do not require CE marking as well. This will then also apply to trivial items and non-electrical products such as furniture, textiles and some purely mechanical products.

A revision of the Product Safety Directive is scheduled for 2022. Whereas the Market Surveillance Regulation (EU) 2019/1020 last year substantially expanded the obligations of manufacturers and distributors of products subject to CE marking, this year there are plans to tighten the rules for products not subject to CE marking as well.

This will then also apply to trivial items and non-electrical products such as furniture, textiles and some purely mechanical products. In particular, the requirements for the technical documentation well be revised. To date, there have been no or only indirect requirements in this regard. This is now about to change.

In line with CE products, the technical documentation will need to be analysed and kept in custody. Distributors will likewise be held more accountable for ensuring the compliance of the products they offer for sale.
