New registration obligation for packaging in Spain

The Spanish packaging law obliges producers to register their packaging. Distributors from abroad must also register through an authorised representative if they sell packaged products in Spain.

Since 16 July 2021, it is against the law to sell products with CE marking without a Responsible Person in the EU. In addition, a Responsible Person must also be specified in accordance with the General Product Safety Regulation (EU) 2023/988.

RoHS: Mercury is banned in some lamp applications

Mercury may no longer be used for certain applications in light sources. The prohibitions now adopted apply subject to a transition period per application of 12 months to 5 years after adoption by the EU Parliament.

On 13 December 2021, the EU Commission adopted 11 amendments to the RoHS Annex. These amendments relate to previously applicable exemptions for mercury from the 0.1 ppm by weight limit in materials. Mercury may no longer be used for certain applications in light sources.

The prohibitions now adopted apply subject to a transition period per application of 12 months to 5 years after adoption by the EU Parliament. You can view the full press release by the EU Commission here.

Economic operators responsible for lighting products, such as manufacturers, importers and fulfilment service providers, should prepare for these prohibitions at an early stage and call for appropriate proof from their suppliers.
