New registration obligation for packaging in Spain

The Spanish packaging law obliges producers to register their packaging. Distributors from abroad must also register through an authorised representative if they sell packaged products in Spain.

Since 16 July 2021, it is against the law to sell products with CE marking without a Responsible Person in the EU. In addition, a Responsible Person must also be specified in accordance with the General Product Safety Regulation (EU) 2023/988.

Right to repair includes smart labelling for consumer information

MEPs are calling for possible smart labelling tools such as QR codes or digital product passports, as well as a possible joint liability mechanism between manufacturers and sellers in case of product non-compliance.

As the EU Parliament reported, the latter adopted (by 509 votes to 3 with 13 abstentions) its demands for a European Commission proposal on the “right to repair” planned for 2022. The MEPs are calling for products to be designed to last longer, to be safe to repair, and for their parts to be easily accessible and removable.

In addition, the MEPs call for harmonised rules for such consumer information, including details on repair ratings, estimated useful life, spare parts, repair services and the period during which software updates are available.
