New registration obligation for packaging in Spain

The Spanish packaging law obliges producers to register their packaging. Distributors from abroad must also register through an authorised representative if they sell packaged products in Spain.

Since 16 July 2021, it is against the law to sell products with CE marking without a Responsible Person in the EU. In addition, a Responsible Person must also be specified in accordance with the General Product Safety Regulation (EU) 2023/988.

REACH: Avoiding harmful substances in products - what does Amazon demand?

Since the new Market Surveillance Regulation took effect, Amazon has had to assume increased responsibility for complying with REACH requirements and has been calling for evidence of REACH compliance from Amazon marketplace traders for some time now.

Limits apply to harmful substances in products in the EU. In particular, the Regulation on Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH Regulation) governs the handling of several hundred problematic substances.

Since the new Market Surveillance Regulation took effect, Amazon has had to assume increased responsibility for complying with REACH requirements and has been calling for evidence of REACH compliance from Amazon marketplace traders for some time now. For suppliers of jewellery articles, for instance, manufacturer declarations of conformity or test reports on the content of substances of very high concern (SVHCs) and heavy metals are required to be submitted. The documents to prove REACH conformity must contain certain mandatory information.

It is difficult for manufacturers, importers or distributors to keep up to date with the REACH evidence rules. For instance, the list of SVHCs (Substances of Very High Concern) changes about twice each year.
