New registration obligation for packaging in Spain

The Spanish packaging law obliges producers to register their packaging. Distributors from abroad must also register through an authorised representative if they sell packaged products in Spain.

Since 16 July 2021, it is against the law to sell products with CE marking without a Responsible Person in the EU. In addition, a Responsible Person must also be specified in accordance with the General Product Safety Regulation (EU) 2023/988.

Packaging in Spain: Update

It is imperative that you act as quickly as possible and register for the take-back of industrial and commercial packaging that you place on the market in the future.

This information is particularly of interest to you, if you put household and/or industrial and/or commercial packaging on the market in Spain. Enforcement of the new packaging waste legislation Royal Decree 1055/2022 has catalysed some significant developments in the Spanish market. The legislation came into force on 29th December 2022. Following are the key details: 

1. New take-back schemes emerging in Spain 

After the enforcement of the new legislation for packaging waste in Spain, the dynamics of the market seem to be changing, as many new take-back-schemes appear to fix their feet in the market in coming times. Many of the existing take-back schemes active in WEEE and Battery sector are looking to get their authorization for the packaging waste as well. 

2. Packaging take-back scheme not a monopoly any more 

So far, the packaging waste channels were managed and controlled by only one player, namely Ecoembes. Nevertheless, the developments induced by the new legislation have resulted into breaking the monopoly and bringing more players, which will facilitate healthy competition and better services in the near future. take-e-way is in the process of establishing cooperation with multiple take-back schemes, enabling us to offer the best suited service provider to you for your specific needs. 

3. EPR to cover industrial and commercial packaging 

Another radical change and making it obligatory 1st January 2025 onwards. Corresponding measures are expected from the existing and upcoming tack-back schemes to include new packaging categories into their portfolio. Although the legislation is already in force since 29 December 2022, the obligation to register industrial and commercial packaging will be mandated on 1st January 2025. 4. Roadmap to the packaging waste compliance 

  • All the foreign producers are obliged to appoint an Authorized Representative in Spain and join the SCRAP system (take-back scheme) 
  • EPR Registration for packaging waste with the authorities 
  • Legitimate quantity reporting of the packaging material via respective authorized representative
