New draft Regulation on General Product Safety

A new provision that has also remained in the draft regulation despite criticism is the consumer’s right to redress in the case of product recalls. Such recalls will thus not only be more expensive for the manufacturer, importer and possibly also for the seller, but also more formally complicated.

The EU Parliament, Council and Commission have adopted a joint draft of the new General Product Safety Regulation. As trade-e-bility noted in August, the legislation is intended to accommodate new products and distribution channels. The final compromise version ST_16312_2022_INIT has been available in English since 21 December 2022.

A new provision that has also remained in the draft regulation despite criticism is the consumer’s right to redress in the case of product recalls. Such recalls will thus not only be more expensive for the manufacturer, importer and possibly also for the seller, but also more formally complicated. The regulation still has to be published in the EU Official Journal before it enters into force. trade-e-bility monitors the changes in product legislation for its clients, provides individually tailored information along with advice regarding implementation. Moreover, trade-e-bility also provides fast and competent support in dealing with product recalls. The example also shows that optimal Legal monitoring is necessary as an existential risk precaution in order to protect you under product law.

The consultancy team at trade-e-bility will be pleased to advise you about solutions with which you can secure your sales success in the field of product safety. Please call +49/40/75068730-0 or send an e-mail to beratung@trade-e-bility.de.
