New registration obligation for packaging in Spain

The Spanish packaging law obliges producers to register their packaging. Distributors from abroad must also register through an authorised representative if they sell packaged products in Spain.

New draft Regulation on General Product Safety

A new provision that has also remained in the draft regulation despite criticism is the consumer’s right to redress in the case of product recalls. Such recalls will thus not only be more expensive for the manufacturer, importer and possibly also for the seller, but also more formally complicated.

The EU Parliament, Council and Commission have adopted a joint draft of the new General Product Safety Regulation. As trade-e-bility noted in August, the legislation is intended to accommodate new products and distribution channels. The final compromise version ST_16312_2022_INIT has been available in English since 21 December 2022.

A new provision that has also remained in the draft regulation despite criticism is the consumer’s right to redress in the case of product recalls. Such recalls will thus not only be more expensive for the manufacturer, importer and possibly also for the seller, but also more formally complicated.
