New registration obligation for packaging in Spain

The Spanish packaging law obliges producers to register their packaging. Distributors from abroad must also register through an authorised representative if they sell packaged products in Spain.

New German Market Surveillance Act extends competences of surveillance authorities to include products non-harmonised to date

On 15 April 2021, the German Bundestag provided information on the presentation of draft legislation for the reorganisation of market surveillance in Germany. For non-harmonised products, this will mean that every economic operator, whether manufacturer, importer, fulfilment service provider or distributor, will now be obliged to provide information on a product to the market surveillance authorities.

On 15 April 2021, the German Bundestag provided information on the presentation of draft legislation for the reorganisation of market surveillance in Germany. The Act is intended to specify the provisions of the European Market Surveillance Regulation for Germany and also to extend them to products currently not harmonised in the EU and which are encompassed by the Product Safety Act.

For non-harmonised products, this will mean that every economic operator, whether manufacturer, importer, fulfilment service provider or distributor, will now be obliged to provide information on a product to the market surveillance authorities.

Platform operators in particular should be clear about their role as economic operators and take precautions where necessary.
