New registration obligation for packaging in Spain

The Spanish packaging law obliges producers to register their packaging. Distributors from abroad must also register through an authorised representative if they sell packaged products in Spain.

LUCID number deposited with online marketplaces

The law firm IT-Recht-Kanzlei informs that generally online marketplaces, i.e. in addition to Amazon and eBay also etsy, Hood, Kasuwa, Kaufland and others, are obliged from 1 July 2022 to check whether their traders act in conformity with the Packaging Act.

take-e-way had comprehensively reported on 7 June 2022, that sales are no longer permitted without LUCID. In this connection, particular attention was paid to the online marketplaces Amazon and eBay.

The law firm IT-Recht-Kanzlei now informs that generally online marketplaces, i.e. in addition to Amazon and eBay also etsy, Hood, Kasuwa, Kaufland and others, are obliged to check whether their traders act in conformity with the Packaging Act. Accordingly, operators would like to protect themselves in order not to violate this new obligation. The law firm IT-Recht-Kanzlei recommends: “Irrespective of this, you should identify the electronic marketplaces on which you place offers. Each of these marketplace operators will sooner or later demand proof of this. Even if this is not the case at present, you should in any case have everything prepared by 1 July 2022 in order to be able to deliver proof quickly. We recommend that you act now and, if necessary, proactively approach the operator if you cannot currently find a way to provide proof.”
