Importers to be liable for defective products

If someone receives a damaged article, the importer or the manufacturer’s authorised representative are to be held liable for it. Companies that take care of the storage or shipping of an order could also be held responsible for cases of damage.

As reported by the Handelsblatt or also ChannelObserver, the ambassadors of the EU member countries agreed on a common position on a new law for liability in case of defective products on 14 June 2023, because people increasingly buy from manufacturers who are not based in the EU. In such cases, the same protection for consumers is to apply as for products from EU companies and the importer or the manufacturer’s authorised representative are to be held liable in future, as well as, in the last instance, companies that take care of the storage or shipping of an order.

In a next step, the European Parliament will vote on its position on the directive, then a final text will still need to be negotiated.
