New registration obligation for packaging in Spain

The Spanish packaging law obliges producers to register their packaging. Distributors from abroad must also register through an authorised representative if they sell packaged products in Spain.

From 25 December 2019, all mandatory energy labelling requirements for luminaires will cease to apply

With effect from 25 December 2019, all energy labelling requirements for luminaires in advertising, technical advertising material, etc. will cease to apply. The energy labelling requirements for lamps will remain unchanged until 1 September 2021.

On 5 December 2019, Delegated Regulation 2019/2015 of the EU Commission regarding energy labelling of light sources was published in the Official Journal of the EU. The existing Regulation 874/2012/EU will be repealed in two stages:
 
With effect from 25 December 2019, all energy labelling requirements for luminaires in advertising, technical advertising material, etc. will cease to apply.
 
Our partner IT-Recht-Kanzlei (IT law firm) points out that online labelling is still mandatory for luminaires until 25 December 2019 and is of the opinion that no labelling ban is justified after 25 December 2019. On the other hand, it is to be expected that online traders who apply energy labelling to luminaires beyond 25 December 2019 will be threatened with cease and desist letters. To be on the safe side, it is therefore recommended to remove both online energy labelling (online labels, arrows, efficiency classes and efficiency spectra) and labelling in stationary trade for luminaires from offers and advertising.
 
As we have read in the paper released by the German Environment Agency, the EU Commission is of the opinion that luminaires placed on the market before 25 December 2019 and bear the label can still continue to be sold. Further information in this regard is available at:

The energy labelling requirements for lamps will remain unchanged until 1 September 2021.
 
Moreover, from 1 September 2021, light sources affected must be provided with the new energy label with a scale of energy efficiency classes from A - G. For light sources already on the market that still bear an old label, a transitional period of 18 months will be granted to traders for relabelling.
