EU Toys Directive versus Toys Regulation

The entry into force of the Toy Safety Regulation will further increase the awareness of high-risk products, which should cover the need for a stricter set of rules compared to the existing Toy Safety Directive, especially when it comes to the efficiency of market surveillance.

As our partner Reusch Law reports, toys of all kinds are “evergreens” in the EU’s RAPEX notification system. Evidently, the supervisory authorities already have toy safety increasingly on their radar today. The entry into force of the Toy Safety Regulation will further increase the awareness of high-risk products, which should cover the need for a stricter set of rules compared to the existing Toy Safety Directive, especially when it comes to the efficiency of market surveillance.

Despite an initiative launched as early as calendar year 2021 to revise the European Toys Directive 2009/48/EC, its adoption is still pending.
