New registration obligation for packaging in Spain

The Spanish packaging law obliges producers to register their packaging. Distributors from abroad must also register through an authorised representative if they sell packaged products in Spain.

EU Parliament Adopts Rules for Packaging

This is Parliament's response to citizens' expectations to build a circular economy, avoid waste, phase out unsustainable packaging and combat the use of single-use plastic packaging.

The European Parliament adopted new EU-wide rules for packaging on 22 November 2023. The report, which represents the Parliament's mandate for negotiations with EU governments, was adopted with 426 votes in favour, 125 against and 74 abstentions. You can find the key points and objectives here:

  • Reduction of packaging (5 % by 2030, 10 % by 2035 and 15 % by 2040)
  • Reduction of plastic packaging (10 % by 2030, 15 % by 2035 and 20 % by 2040)
  • Ban on the sale of very light plastic carrier bags (less than 15 microns), unless they are required for hygiene reasons or are used as primary packaging for loose food to prevent food waste
  • Reducing or restricting the use of certain disposable packaging, such as miniature packaging for toiletries in hotels and shrink-wrap for suitcases in airports
  • Ban on the use of so-called "forever chemicals" (perfluorinated and polyfluorinated alkyl substances or PFAS) and bisphenol A in food contact packaging to prevent damage to health
  • Retailers of takeaway food and drink in the catering sector, such as hotels, restaurants and cafés, should give consumers the option of bringing their own container.
  • All packaging must be recyclable and fulfil strict criteria laid down in secondary legislation. Certain temporary exemptions are provided, for example for food packaging made of wood and wax.
  • EU countries should ensure that 90% of the materials used for packaging (plastic, wood, ferrous metals, aluminium, glass, paper and cardboard) are collected separately by 2029.

Next step: Parliament is ready to start talks with national governments on the final form of the law once the Council has adopted its position.
