Ecodesign Regulation is coming

All types of goods that are placed on the market in the EU are affected. The new regulation includes a direct ban on the destruction of unsold textiles and shoes. Other products could follow.

As reported by the European Council, on 27 May 2024, as the final step in the decision-making process, it adopted the Ecodesign Regulation, which sets out requirements for sustainable products. The regulation replaces the existing Ecodesign Directive 2009/125/EC and extends its scope: in addition to energy products, the new legislation now applies to all types of goods placed on the EU market.

The regulation applies to all types of products with only a few exceptions (such as vehicles and products from the security and defence sectors). It introduces new requirements concerning aspects such as durability, reusability, upgradability and reparability of products. It also covers the presence of substances that prevent recyclability, as well as energy and resource efficiency. Other requirements relate to the proportion of recycled materials, reprocessing and recycling, the carbon footprint and environmental footprint as well as information requirements, including a digital product passport. The new regulation includes a direct ban on the destruction of unsold textiles and footwear (with a temporary exemption for SMEs). Other products could follow if the Commission uses its power to introduce similar bans.

Once the Council has given its consent, the legal act is adopted. After being signed by the President of the European Parliament and the President of the Council, the regulation is published in the Official Journal of the European Union and enters into force 20 days after publication.
