After the Chinese online marketplace Temu received a warning (trade-e-bility reported), the company has issued a cease-and-desist declaration. According to the Federation of German Consumer Organisations (vzbv), Temu undertakes to refrain from all infringements criticised by the vzbv (e.g. use of manipulative designs).
Contrary to many expectations, the lack of registration of individual products in the sense of extended producer responsibility or deficiencies in the area of product compliance, which are a major problem for the members of the VERE Association, which represents the interests of legally compliant companies, were not part of the warning letter or legal considerations by the vzbv. The online marketplace's declaration of discontinuance is therefore not a glimmer of hope. ChannelObserver also reports that this does not solve the problem of unfair competition.
However, there are prospects of a reorganisation of EU import regulations. For example, tagesschau.de reports that Germany (Federal Minister of Finance Christian Lindner) has signalled its support for an end to the 150-euro regulation at European level: "Currently, no customs duties have to be paid on import for parcels with a value of less than 150 euros - low-cost retailers from the Far East such as Temu and Shein benefit from this." This is how the flood of parcels from Asia is now to be countered at European level.
