Charging points for e-vehicles fall under the Electronic Equipment Act

On 5 March 2021, Germany’s upper house (Bundesrat) approved the legislation recently passed by the Bundestag to establish a building-integrated charging and line infrastructure for electromobility. The Act is intended to accelerate the expansion of charging infrastructure for electromobility in buildings. Depending on their size, charging points for e-vehicles fall under the Electrical and Electronic Equipment Act (ElektroG – German WEEE conversion) and are required to be registered with the EAR foundation (German WEEE registration board).

On 5 March 2021, the Bundesrat approved the legislation recently passed by the Bundestag, namely the Act to establish a building-integrated charging and line infrastructure for electromobility. Accordingly, it can now be forwarded to German Federal President for signature. After signature by the Federal President, the Act can be promulgated in the Federal Law Gazette. It is scheduled to take effect on the day thereafter.

The Act is intended to accelerate the expansion of charging infrastructure for electromobility within buildings.

According to the Federal Network Agency's charging point register, there are 34,029 public charging points for electric vehicles in Germany. This was announced by the Federal Government in its reply (19/26303) to a minor enquiry by the FDP parliamentary group (19/25970).

Depending on their size, charging points (charging stations / wall boxes) for e-vehicles fall under the Electrical and Electronic Equipment Act (ElektroG – German WEEE conversion) and are required to be registered with the EAR foundation (German WEEE registration board). An insolvency-proof guarantee is required to this end. Regular quantity reports are to be made.
