Bundesrat approves ElektroG amendment

Operators of electronic marketplaces and fulfilment service providers have another six months, until 1 July 2023, until they have to comply with the newly introduced mandatory verification of registration with the EAR foundation. The originally planned reclassification of boilers and hot water storage tanks, however, was cancelled by the government after protests from waste disposal companies and at the request of the Bundesrat.

As Euwid reports, the Bundesrat has approved the amendment to the Electrical and Electronic Equipment Act (ElektroG) proposed by the Federal Government and has refrained from convening the mediation committee.

Operators of electronic marketplaces and fulfilment service providers thus have a further six months, until 1 July 2023, to comply with the newly introduced mandatory registration verification. This is the obligation to check whether producers/sellers have properly registered their electrical and electronic equipment with the EAR foundation (German WEEE and battery registration board). What this means: If producers (traders can also be producers within the meaning of ElektroG) or authorised representatives are not properly registered or not registered at all, operators of electronic marketplaces may not enable their electrical equipment to be offered or made available.
