New registration obligation for packaging in Spain

EU Batteries Regulation corrected

The amendment to the EU Batteries Regulation specifies the requirements for the conformity assessment of batteries. The main change concerns the distinction between batteries produced in series and those not produced in series.

The amendment to the EU Batteries Regulation concerns Article 17(2) and specifies the requirements for the conformity assessment of batteries in accordance with Articles 7 and 8. The main change concerns the distinction between batteries produced in series and batteries not produced in series:

  • Batteries produced in series: The conformity assessment is carried out according to module D1 (quality assurance related to the production process) in accordance with Annex VIII Part B.
  • Non-series produced batteries: Module G (conformity on the basis of individual verification) in accordance with Annex VIII Part C applies here.

Significance for sellers and producers

  1. More precise conformity assessment requirements: producers must ensure that they apply the correct procedure for their battery types.
  2. Increased clarity in the application: The explicit differentiation between standard and non-standard batteries enables a clear allocation of the assessment methods.
  3. Legal certainty for market participants: The clarification prevents misinterpretations and helps companies to behave in a legally compliant manner.

Sellers and producers should ensure that the correct conformity assessment procedures are followed to meet regulatory requirements.

For all batteries placed on the market for the first time since 18 August 2024, there is an obligation to draw up an EU declaration of conformity and to affix a CE marking in accordance with Art. 38 Para. 3 of the Batteries Regulation (EU) 2023/1542.

In Articles 41 (2) b and 42 (2) b, the EU Batteries Regulation requires importers and sellers to ensure that the batteries bear a compliant CE marking before placing a battery on the market. This applies regardless of whether the battery is installed in a device or sold separately. Your batteries do not fulfil the requirements?
