New registration obligation for packaging in Spain

The Spanish packaging law obliges producers to register their packaging. Distributors from abroad must also register through an authorised representative if they sell packaged products in Spain.

No sale in Austria without authorised representative

The new Austrian Packaging Ordinance has been in force since 1 January 2023. You cannot submit a declaration for 2025 without a registered, authorised representative. Please note that this may mean that the goods you deliver to your Austrian customers are not fulfilling the legal obligations.

The new Austrian Packaging Ordinance has been in force since 1 January 2023. For all deliveries to private end users, an authorised representative must be appointed as a foreign distributor not based in Austria. For deliveries to retailers in Austria, pre-licensed imports can be made with an authorised representative based in Austria, but only for companies based within the EEA. The regulation has been in force since 1 January 2023. In response, get-e-right Austria GmbH was founded to continue guaranteeing legally compliant sales for our customers.

Due to the failure to appoint an authorised representative in due time, take-back systems in Austria were forced to terminate existing old contracts with effect from 31 December 2024. As a result, affected producers who sell to private end users are placing their sales, which are already not legally compliant, on an even more uncertain foundation, as the possibility of reporting quantities placed on the market is now definitively ruled out. Pursuant to Section 79 (7) of the Austrian Waste Management Act (AWG), the consequences for companies based in Germany, for example, could mean a doubling of the current and past advance disposal fees.

You cannot submit a declaration for 2025 without an appropriately registered, authorised representative. Please note that this means that the goods you supply to your Austrian customers may not fulfil the legal obligations.
