New registration obligation for packaging in Spain

The Spanish packaging law obliges producers to register their packaging. Distributors from abroad must also register through an authorised representative if they sell packaged products in Spain.

Austria: Authorised representative for packaging is mandatory

Both companies based in the EU that continue taking over the responsibility for their customers in the B2B sector and foreign distance sellers in the B2C sector (e.g. sales to consumers via a web shop) must appoint an authorised representative based in Austria from 1st January 2023. This obligation to appoint an authorised representative also applies to single-use plastic products.

As take-e-way reported, according to the new legal provisions, all non-Austrian companies (both EU and non-EU based) selling directly to private end-users have to appoint an authorised representative for their packaging put on the market as of 1st January 2023. We have subsequently received numerous enquiries from our customers. Therefore, we would like to provide you with additional information today.

As of 1st January 2023, amendments to the Austrian Waste Management Act and the Packaging Ordinance will come into force. From then on, it will no longer be possible for foreign companies to take over the responsibility for their Austrian customers (downstream distribution stages) as before.
