New registration obligation for packaging in Spain

The Spanish packaging law obliges producers to register their packaging. Distributors from abroad must also register through an authorised representative if they sell packaged products in Spain.

Amazon validates WEEE registration

As take-e-way customers report, Amazon is already taking its forthcoming inspection obligation under the German Electrical and Electronic Equipment Act (ElektroG) very seriously. For instance, take-e-way has an Amazon letter with the subject “Action needed - EPR Requirement for EEE”, in which Amazon requests its sales partners to enter the WEEE registration number in the Amazon Compliance Portal, which Amazon will validate with the relevant government authority or producer responsibility organisation (PRO).

As take-e-way already reported, operators of electronic marketplaces and fulfilment service providers are required to check as of 1 July 2023 whether manufacturers/sellers have duly registered their electrical and electronic equipment with the Elektro-Altgeräte Register (EAR) foundation (German WEEE and battery registration board). If manufacturers (sellers can also be manufacturers within the meaning of ElektroG) or authorised representatives are not properly registered or not registered at all, operators of electronic marketplaces may not enable their electrical equipment to be offered or made available.

For instance, take-e-way has an Amazon letter with the subject “Action needed - EPR Requirement for EEE”, in which Amazon requests its sales partners to enter the WEEE registration number in the Amazon Compliance Portal, which Amazon will validate with the relevant government authority or producer responsibility organisation (PRO). Amazon sellers will receive such a letter if:

  • the WEEE registration number indicated does not match the information in the EAR register,
  • the WEEE registration number indicated exists but has expired,
  • the WEEE registration number, brand or manufacturer’s name indicated does not match the information filed with the EAR foundation,
  • the registration number indicated cannot be found in the register.

After validation by Amazon, the status next to the number changes from “Submitted” to “Valid” or “Invalid + reason for invalid”. If the status is “Valid”, then no further action is required. However, if the status is “Invalid”, further action needs to be taken. In addition, Amazon recommends that you check the Compliance Portal regularly, even if you have already completed all due “WEEE Reg. numbers” submitted, as updates will be made and further brands may appear in the future in accordance with your entry.
